Terms Of Sale

1. THESE TERMS

1.1 These are the terms and conditions on which we supply products to you.

1.2 Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

2. INFORMATION ABOUT US AND HOW TO CONTACT US

2.1 We are J W Anderson Limited (company number 06316966, VAT Number GB 972964175 IT 07040650488) whose registered office is at 21 Parr Street, Hoxton, London N1 7GW.

2.2 You can contact us by telephoning our customer service team at +44 20 3994 5262 or by writing to us at help@jwanderson.com.

2.3 If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

3. OUR CONTRACT WITH YOU

3.1 We have an agreement with Global-e, a sales facilitation and e-commerce partner, allowing Global-e to act as the merchant of record, in Global-e’s name and on our behalf. By placing your order to purchase one or more products through the checkout, you confirm that you have read and understood these Terms of Sale, the Website Terms of Use (above) our Privacy and Cookie Policy, along with Global-e’s Privacy Policy and Terms and Conditions (which are available on the checkout) in their entirety (together the ‘Terms’), and you agree to be bound by them.

The Terms define your legal relationship regarding the checkout, the placement of orders, and the purchase and delivery of products underlying such orders. If you do not agree to the Terms, please do not complete your order.

These Terms are in, and are governed by, the English language. You agree that any translation, if provided, is available for your convenience only (unless otherwise required by applicable law).

3.2 The information contained in these Terms, and the information displayed on the Website and checkout, constitute only an invitation to contract. Your Order is not accepted (and therefore no commitment is made to sell or provide you with the Products), and no contract for the sale of such Products will come into effect, until you receive an email explicitly stating that the Order has been accepted and confirmed ("Order Confirmation"). The contract is concluded in the dispatch country (where the contract for the sale of the Order is concluded).

3.3 We will not be obliged to supply any other Product(s) which may have been part of your order until the despatch of such Product(s) has been confirmed in a separate despatch confirmation.

3.4 If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

3.5 To shop with us or receive services from JW Anderson, you need to:

  • be at least 16 years old;
  • have a credit or debit card that we accept; and
  • be authorised to use that credit or debit card (it is in your name or you have permission to use it).

Some of the goods sold through our websites may not be suitable for under 18s.

4. PRODUCTS

4.1 The Products on the Website are owned and sold by JW Anderson. JW Anderson attempts to be as accurate as possible in the description of the Products. However, we cannot guarantee that any descriptions are totally accurate, complete, reliable, or error-free. The images of the Products on the Website are for illustrative purposes only. Although we attempt to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflects the colour of the Products.

4.2 As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice or Trading Standards office. Nothing in these Terms and Conditions will affect these legal rights.

4.3 The Products sold are supplied for your domestic and private use only. You agree that you will not use the Products for any commercial, business or re-sale purposes. Neither JW Anderson nor Farfetch has any liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

5. ORDERING AND AVAILABILITY

5.1 Products may be ordered by clicking on the items you wish to purchase and then following the prompts that will appear on-screen. You may check and correct any input errors in your order up until the point at which you submit your order to us by clicking the "Pay Now" button on the checkout page.

5.2 The costs of delivery will be as displayed to you on our website.

5.3 After placing an order, you will receive an email from us acknowledging that we have received your order and giving you an order reference number. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by clicking on the "Pay Now" button, you enter into an obligation to pay for the Product(s). Where we accept your order, we will confirm such acceptance to you by sending you an email that confirms that the Product has been despatched (Despatch Confirmation) and a contract is only formed as set out in paragraph 3 above.

6. PRE-ORDERS

6.1 All items are available to ship unless it is a pre-order item. Customers will be placed on a priority waiting list for pre-order items. All pre-order items have an estimated ship date, which indicates the date that the item will ship out from the warehouse, but these items may arrive sooner or later than specified. The estimated shipping date is published online. JW Anderson is not liable for delays, cancellations or changes to pre-ordered items made during production.

6.2 Credit cards are charged at the time of the pre-order, subject to our usual fraud checks. If a pre-ordered item will not ship out by the estimated shipping date, the customer will be notified and, at the customer’s election, either refunded in full or provided with an updated estimated shipping date. If an order includes both available and pre-ordered items, at least two separate deliveries will be most likely made to the customer.

7. DELIVERY

7.1 Your order will be fulfilled by the delivery date set out in the Despatch Confirmation or, if no delivery date is specified, then within 30 days after the date of the Despatch Confirmation, unless there are exceptional circumstances.

7.2 Your order will be delivered to the delivery address you specify when placing your order.

7.3 If your delivery address is geographically remote, for example certain outlying islands or other isolated locations, it is possible that we may not be able to deliver there. If that is the case, we will notify you before we accept your order. We reserve the right not to deliver to any country/region that is prohibited by applicable export laws. Orders cannot be delivered to PO Box or similar addresses.

7.4 If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

7.5 Products comprised within the same order cannot be delivered to different addresses.

7.6 Deliveries are made by our trusted courier and take place on Monday to Friday (or other normal working weekdays in countries that do not follow a Western pattern of working week), excluding bank and public holidays, usually within the hours of 8am and 5pm. It is not possible to specify a precise time at which a delivery will take place. Please note that the courier may require deliveries to be signed for.

7.7 Please note that the delivery logistics service is being provided by Global-Eto you, the customer, and as such you are entering into a contract for delivery services provided by Global-E.  If there is a charge for these services, it will be shown to you prior to checkout and your purchase of the products.

7.8 If you order Product(s) for international delivery, they may be opened and inspected by customs authorities and may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You are responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. In the event that you return an item, the import duties will be refunded if they were originally included in the purchase price. If they were not included then you will responsible for reclaiming duty directly from your local customs office.

7.9 Please also note that you must comply with all applicable laws and regulations of the country/region for which the Product(s) are destined. We will not be liable for any breach by you of any such laws.

8. RISK AND OWNERSHIP

The Product(s) ordered will be at your risk from the time of delivery or collection (as the case may be). Ownership of the Product(s) ordered will also pass to you on delivery or collection (as the case may be), provided full payment of all sums due in respect of the Product(s), including any delivery charges, has been received.

9. PRICE AND PAYMENT

9.1  The price of Products is as quoted on the Site from time to time.

9.2 Prices include VAT but exclude delivery costs, which will be automatically added (at the cost shown) to the total amount due when you view the items in your shopping basket and have selected your chosen different delivery method.

9.3 Prices and delivery costs are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Despatch Confirmation.

9.4 The Site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on the Site may be incorrectly priced. We will normally verify prices as part of our despatch procedures so that, where a Product's correct price is less than our stated price, we will charge you the lower amount. If a Product’s correct price is higher than the price stated on the Site, we will normally, at our discretion, either contact you for instructions before despatching the Product, or reject your order and notify you of such rejection. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any Products provided to you.

To continue with your order you will need to select one of our other payment types at checkout.

9.6  You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. We also carry out a standard pre-authorisation check on your payment card, and Products will not be despatched until this pre-authorisation check has been completed. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

9.7 From time to time we may run promotions where we issue discount codes. These can be used in part-payment of the price of Product(s) ordered online, subject to the terms and conditions under which they were issued (as indicated in our relevant promotion from which you got the code). Northern Irish designer Jonathan Anderson established JW Anderson in 2008.

At first an elaborate collection of accessories quickly attracted attention, enabling the fledgling label to show on-schedule during 2008’s London Fashion Week.

The success of this debut collection earned both critical acclaim and commercial success for Anderson, whose label is now regarded as one of London’s most innovative and forward thinking brands.
Its unique design aesthetic offers a modern interpretation of masculinity and femininity by creating thought-provoking silhouettes through a conscious cross-pollination between menswear and womenswear elements. This idiosyncratic perspective, which earned the label a cult following, prompted JW Anderson to present a women’s capsule collection in 2010. A steady growth in demand gave occasion to JW Anderson first stand-alone on-schedule women’s show at London Fashion Week. International editors and buyers have also taken note, gaining the label a prominent reputation in the US, Europe and Asian markets. Key stockists include Barneys, Opening Ceremony, Dover Street Market, and Jeffrey in the US. European stockists include Dover Street Market, Selfridges, Le Bon Marche and Printemps.

Joyce, Isetan & 10 Corso Como are key advocates in Asia, whilst Net-a-Porter, Moda Operandi, Matches & Mr Porter are the main online shopping destinations for JW Anderson pieces.

JW Anderson has evolved into an internationally renowned and award-winning brand. In the past accolades have included British Fashion Awards for ‘Emerging Talent, Ready-to-Wear’ (2012), ‘The New Establishment Award’ (2013) and ‘Menswear Designer of the Year’ (2014).

At the 2015 British Fashion Awards the brand received an historic double award for ‘Mens-wear’ and ‘Womenswear Designer of the Year’, the first time any brand has ever won both prestigious awards. Most recently, at the 2017 British Fashion Awards the brand received the award of 'Womenswear Designer of the Year'.

A recent investment by LVMH Moet Hennessy further cements JW Anderson’s status as a rising, new-generation brand. Following the investment Jonathan Anderson was also appointed Creative Director of Loewe, and works on both brands in tandem.
